Frequently Asked Questions
What is the difference between a Basic Assessment (BA) and a full Environmental Impact Assessment (EIA)?
Under South Africa's NEMA EIA Regulations, activities listed in Listing Notices 1 and 3 require a Basic Assessment (BA) — a more concise process suited to smaller-scale activities whose impacts are generally well understood and manageable. Activities listed in Listing Notice 2 require a full Scoping and EIA process — a more comprehensive assessment, including detailed specialist studies, for larger developments likely to have a significant environmental impact.
Do I need a Water Use Licence (WUL) for my project?
Under Section 21 of the National Water Act, certain water uses — such as taking, storing, or diverting water, or discharging waste into a water resource — must be licensed unless they fall under Schedule 1, qualify as an existing lawful use, or are covered by a General Authorisation. We assess your specific water use against these criteria to determine whether a Water Use Licence, a General Authorisation, or a registration is the appropriate route.
What is an Environmental Legal Compliance Audit?
An Environmental Legal Compliance Audit systematically reviews your operations against applicable environmental legislation, permit conditions, and authorisation requirements to identify gaps and non-compliances before they become regulatory risks. The audit typically informs a legal register and a risk profile that guides your ongoing compliance programme.
When is waste classification required under NEM:WA?
Under the National Environmental Management: Waste Act, waste generators are responsible for classifying their own waste using the national Waste Classification and Management System. Classification determines whether waste is hazardous and, if it is destined for landfill, which class of landfill it may be disposed at — an assessment usually based on laboratory testing of waste samples.
What does External Auditing of an Environmental Authorisation involve?
External auditing independently verifies that a facility or project is meeting the conditions of its Environmental Authorisation, Water Use Licence, Waste Management Licence, or Atmospheric Emission Licence. It typically includes site inspections, document review, and a formal report highlighting compliance status and any corrective actions required.
What does an Environmental Control Officer (ECO) do?
An Environmental Control Officer is an independent specialist appointed to monitor a project's compliance with its Environmental Authorisation and Environmental Management Programme (EMPr) throughout construction, operation, or rehabilitation. This includes regular site inspections, engagement with contractors, and reporting non-compliances to the project team and regulating authority before they escalate.
